GCA has undertaken a large number of projects involving legal, technical and contractual disputes in a variety of forums including one-on-one negotiations, international commercial arbitrations, unitisation proceedings, courts of law in a number of countries as well as multilateral bodies such as the International Court of Justice and in a variety of roles including being expert witness for one or other of the parties, as the arbitrator and as the arbitral tribunal's expert.
GCA's deep commitment to the integration of technical and commercial aspects in its analytical approach enables it to convey complex technical issues and argumentation into concepts and language that can be readily understood by non-industry experts, counsel, arbitrators, judges and juries.
For a number of years GCA has been significantly involved in work relating to equity determination, field unitisation and in the role of Independent Expert in matters of dispute over the ownership of oil and gas fields. Such disputes are not only cross-permit boundaries, but can also involve international boundaries and thus require inter-government agreement and treaties. The interdisciplinary nature of field participation can involve geoscientists, engineers, administrators, lawyers, accountants and environmental specialists. Although the primary vehicle for determining equity shares is technical, by its very nature the outcome is commercial and the unique blend of technical and commercial experience in GCA serves to makes GCA an ideal advisor in such matters since we can bring all the required skills together in one organisation.
Past proceedings have included a broad range of technical and commercial matters covering issues and topics as varied as gas price/tariff/rates of return determinations; joint operating agreement disputes; partner cross-charging, cost allocation disputes; Production Sharing Contractor audits and settlements; production and reservoir management practices; company /property taxation and valuations and general expert opinion and testimony.
